Terms and Conditions

Use of our website and the sale and purchase of goods from the website are governed by our terms and conditions as set out below.  We or Our means Tots to Travel Ltd trading as thefamilytravelshop.com.  You or Your means the person accessing, using or ordering from our website over the Internet.

 

Disclosed agent

Thefamilytravelshop.com acts as agent in the sale of goods which are supplied by our fulfilment Retailer directly to you. Our fulfilment Retailer is Kids-Away Ltd.  The contract of sale exists between you and the Retailer.  These terms and conditions cover all sales made through this website and our Retailer must comply with our terms and conditions of trading.

 

Prices, description and availability of goods

All prices are shown in GBP (Pounds Sterling). Prices other than those in GBP may be shown and are for guidance purposes only. All goods are sold subject to availability. Both price and availability information is subject to change without notice, hence any subsequent purchases of the same product cannot be guaranteed at the same price. Where goods are temporarily out of stock we will endeavour to contact you so that you may choose between a refund on the item, having it shipped when it is back in stock or selecting an alternative product. Whilst we take the utmost care to ensure the product descriptions, pictures, information and prices are accurate we do not accept liability for any inaccuracies, errors or omissions. Despite our best efforts, a small number of the items displayed on our site may be mispriced. No contract exists between you and our Retailer partner for the sale by our Retailer partner to you of any product unless and until our Retailer partner accepts the order by taking payment for the goods. Our Retailer partner aims to verify prices as part of their payment processing procedures. Orders are accepted at our Retailer partner’s sole discretion and we and our Retailer partner maintain the right to decline orders without giving an explanation. Colours may vary slightly from those shown on the website due to the limitations of Internet technology.

 

Sales tax

Value Added Tax (VAT) is calculated on shipping destination. It is included in the price for orders shipped to destinations within the European Union (EU). For orders shipped to destinations outside the EU the price excludes VAT but orders may be subject to local sales tax or import duty. These are not included in our prices and customers remain liable for payment of these taxes or duties on or following delivery.

 

Payment methods

All orders must be paid for by credit or UK debit cards or Paypal. Unfortunately, we do not accept payment by cheque or postal order, and you cannot pay in instalments. Our fulfilment Retailer accepts Visa (including Delta), Mastercard & American Express.   All prices are in pounds sterling (£) and credit / debit card transactions for orders outside the UK will be converted by the card company at their current exchange rates.

 

Delivery arrangements

Your shopping basket displays the goods you have purchased.  Our Retailer partner will notify you if your goods cannot be despatched within the expected timescale, e.g. some goods may take longer than normal. The delivery costs for each order vary and are shown depending on the shipping destination and the delivery service selected.  Should your delivery address be outside the UK you will receive an email from our fulfilment Retailer requesting details of your required delivery times and further to your response whether this can be reasonably achieved.  You are responsible for providing our fulfilment Retailer with full and accurate details of the delivery address and contact phone number to enable them to deliver the Goods to You.  You acknowledge the particular importance of ensuring that address details are accurate and correct and that particular attention is required for foreign destinations.  Neither We nor our fulfilment Retailer shall be liable for any penalty, loss, damage or expense arising from incorrect or insufficient address details.  If for any reason you fail to accept delivery of any goods when ready for delivery, or our fulfilment Retailer is unable to deliver the Goods on time because you have not provided appropriate instructions, the goods shall be deemed to have been delivered to you.

 

Cooling off period and cancellation / returns

We want you to be satisfied every time you shop with us.  Our "no quibbles" guarantee means that if for any reason you are unhappy with the goods purchased you may cancel your order and return the goods to the Retailer within 7 working days from receipt of the goods, and you will receive a refund within 7 days of cancellation.  It is your responsibility to take care of the goods before returning them, and they must be returned in a state where they can be resold.  This does not affect your statutory rights as a consumer.  Our fulfilment Retailer will not accept return of:

Fresh / disposable / perishable goods (e.g. flowers or fresh foods)

Sealed audio / video / DVD recordings or computer software which have been opened

Goods made to the customer's personal specifications

Bulk Orders are only returnable at the suppliers’ discretion.

Our fulfilment Retailer will provide returns information in with the delivery note/invoice. It is vital that you enclose a covering letter with the return detailing your name, full address, order number and reason for return (please also specify whether you require an exchange or refund).  We recommend that you use Recorded Delivery, as proof of shipping is not proof of receipt.

Unless the goods are defective, damaged or not as specified on your order acknowledgement, you are responsible for the cost of returning goods to the Retailer, and any refund will be made less our costs which include credit card charge, packing and the original delivery charge.  We recommend that you use Recorded Delivery, as proof of shipping is not proof of receipt.  If however the goods are faulty then the postage costs will be refunded.
